Agreement between User and iTerra Solutions, LLC

This Privacy Policy governs data collection and usage and applies to iTerra Solutions, a Virginia limited liability company (the “Company”) and all traffic originating from https// (the “Site”). For purposes of this Privacy Policy, unless otherwise noted, all references to the Company include the Site. By using the Site, you consent to the data practices described in this statement. 

1. Collection of Your Personal Information- In order to better provide you with products and services offered, the Company may collect personally identifiable information, including but not limited to your name, address, phone number, and email address. If you purchase services or products through the Company, the Site collects billing and credit card information. This information is used to complete the purchase transaction. 

The Company does not collect any personal information about you unless you voluntarily provide it. However, you may be required to provide certain personal information to us when you elect to use certain services available on the Site. To wit, the Company will use your information for actions including but not limited to communicating with you in relation to services and/or products you request. The Company also may gather additional personal or non-personal information in the future.


2. Use of Your Personal Information- The Company may use personal information it collects from you to operate the Site and to deliver the services and/or products you request. The Company also use your personally identifiable information to inform you of other products or services available at or from the Company.

Sharing Information with Third Parties- The Company does not sell, rent or lease its customer lists to third parties, but may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (i.e., your e-mail, name, address, and telephone number) is not transferred to the third party. The Company may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to the Company and they are required to maintain the confidentiality of your information. 


The Company may only disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: 

  • Conform to the edicts of the law or comply with legal process served on the Company or the Site; 

  • Protect and defend the rights or property of the Company; and/or 

  • Act under exigent circumstances to protect the personal safety of users of the Company or the public.


4. Tracking User Behavior- The Company may keep track of the websites and pages our users visit within the Site in order to determine which the Company services are most popular. This data is used to deliver customized content and advertising within the Site to customers whose behavior indicates that they are interested in a particular subject area.


5. Automatically Collected Information- Information about your computer hardware and software may be automatically collected by the Company. This information can include but is not limited to your IP address, browser type, domain name(s), access times, and referring website addresses. This information is used for the operation of the Company’s services, to maintain quality of the services, and to provide general statistics regarding use of the Site.  


6. Use of Cookies- The Site may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a webpage server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. One of the primary purposes of cookies is to provide a convenience feature to save you time. 

The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you register with the Site for services, a cookie helps to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, etc.

When you return to the Site, the information you previously provided can be retrieved, so you can easily use the features that you customized. You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Site. 


7. Links- Please be aware that the Company is not responsible for the content or privacy practices of other websites. The Company encourages its users to be aware when they leave the Site and to read the privacy statements of any other website that collects personally identifiable information.


8. Security of Your Personal Information- The Site secures your personal information from unauthorized access, use, or disclosure. When your personal information, such as a credit card number, is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol. The Company strives to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. Unfortunately, no data transmission over the internet or any wireless network can be guaranteed to be 100% secure. As a result, while the Company strives to protect your personal information, you acknowledge by using the Site that there are security and privacy limitations inherent to the internet which are beyond the Company’s control. You also acknowledge that the security, integrity, and privacy of any and all information and data exchanged between you and the Company through the Site cannot be guaranteed.

9. Children Under the Age of Eighteen- The Site does not knowingly collect personally identifiable information from children under the age of eighteen (18). We reserve the right to delete any information identified as having been provided by such individuals at our discretion. If you are under the age of eighteen, you must ask your parent or guardian for permission to use this website.


10. Email Communications- From time to time, the Company may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve services, the Company may receive a notification when you open an email from the Company or click on a link therein. If you would like to stop receiving marketing or promotional communications via email from the Company, you may opt out of such communications by accessing the link at the bottom of every email sent.


11. External Data Storage Sites- The Company may store your data on servers provided by third party hosting vendors with whom the Company has contracted.


12. Changes to the Privacy Policy- The Company reserves the right to change this Privacy Policy from time to time, and will notify you about significant changes in the way it elects to treat personal information by sending a notice to the primary email address specified in your account, placing a prominent notice on the Site, and/or by SSL Protocol updating any privacy information. 

Your continued use of the Site and/or the Company’s services available through the Site after such modifications will constitute your acknowledgement of the modified Privacy Policy and your agreement to abide by and be bound by the modified Privacy Policy.
